Terms of Service

1. Acceptance & eligibility
By creating an account, purchasing a service, submitting information, or otherwise using ghosttrace.net, you accept these Terms and our Privacy Policy. You must be at least 18 years old and legally capable of entering contracts. If you use the services on behalf of an organization, you represent that you are authorized to bind it, and "you" includes that organization.
2. Who we are — critical disclaimer
GhostTrace LLC is a PRIVATE research and cybersecurity firm. WE ARE NOT A LAW ENFORCEMENT AGENCY, we hold no governmental authority, and nothing we produce is a warrant, official investigation, or legal determination. We do not provide legal advice; consult a licensed attorney for legal questions. For emergencies, crimes in progress, or threats to life, contact local authorities immediately (911 in the U.S.).
3. Lawful methodology
All research is performed exclusively with lawfully obtained, publicly available information (OSINT) and client-authorized materials. We do not — and will refuse any request to — access accounts, systems, devices, or private data without authorization; impersonate others to obtain non-public information; or conduct activity that violates the Computer Fraud and Abuse Act (18 U.S.C. § 1030) or any other law. Engagements requesting such conduct will be declined and may be reported.
4. Services & deliverables
Purchased services (consulting, entity and domain due-diligence research, scam response and documentation support, incident documentation, digital safety reviews, malware analysis, and awareness training) become tracked requests in your portal with status updates and secure messaging. As set out in Section 19, our research and documentation services concern businesses, domains, websites, and infrastructure, or a client's own accounts and records — not the identification, location, or profiling of a natural person. Deliverables are professional research reports reflecting information reasonably available at the time using lawful methods. Public information changes constantly; we therefore warrant diligence and methodology, not completeness or specific outcomes. Deliverables are licensed for your internal, lawful use and may not be resold, republished, or represented as law-enforcement records. No guarantee of results. We do not promise or guarantee any particular result, finding, identification, recovery, or outcome. Lawful research is inherently uncertain: the information sought may not exist in public sources, may have been removed, or may be inconclusive, and diligent work may legitimately conclude with no actionable findings. A report of no findings, or of findings different from what you hoped for, is a completed deliverable and does not entitle you to a refund under Section 8. Timelines are good-faith estimates, not commitments; work may be delayed by circumstances such as service or power outages, severe weather, illness, third-party platform unavailability, or other events beyond our reasonable control (see Section 18, Force majeure), and we will communicate any material delay through your portal.
5. Your responsibilities
You agree to: provide accurate information; use findings only for lawful, protective purposes; maintain the confidentiality of your account credentials; promptly review request updates; and notify us of unauthorized account activity. You are responsible for how you act on our findings.
6. Prohibited conduct
You may not use the services to: harass, stalk, dox, threaten, or harm any person; target individuals based on protected characteristics; obtain information for vigilantism, retaliation, or unlawful discrimination; submit knowingly false or bad-faith intelligence reports; upload malware (other than samples explicitly submitted for our Malware Analysis service, clearly labeled); probe, scan, overload, or attack our infrastructure; scrape the platform; misrepresent your identity or affiliation; or violate any applicable law. Violations may result in immediate suspension or termination without refund, and unlawful activity may be reported to authorities.
7. Fees, billing & taxes
Prices are listed in U.S. dollars and processed by Stripe. One-time services are billed at checkout. Subscription plans bill automatically each month until cancelled; you authorize recurring charges when subscribing. Prices may change with at least 14 days' notice for subscriptions, effective the next billing cycle. You are responsible for any applicable taxes not collected at checkout. For a Malware Analysis engagement complex enough to route to our reverse-engineering research partner, Zenvoris, under our joint research collaboration: your payment to GhostTrace covers our own portion of the work; if Zenvoris's involvement goes beyond that collaboration and becomes its own paid engagement, Zenvoris contracts and bills you directly for that portion, and no referral fee or commission is added to your GhostTrace invoice.
8. Refunds & cancellations
One-time services: fully refundable before work begins; once work has commenced, refunds are prorated for undelivered work at our reasonable discretion; completed deliverables are non-refundable. Subscriptions: cancel anytime from Portal → Billing; access continues to the end of the current billing period; no partial-month refunds. Donations are non-refundable except where required by law or made in error (contact us within 14 days). Please contact support before initiating a chargeback — chargebacks filed without contact may result in account suspension pending resolution.
9. Intelligence submissions
Public intelligence submissions are voluntary, may be anonymous, and create no client relationship, no duty to act, and no entitlement to updates. We may deduplicate, retain, action, or discard submissions at our discretion, and where legally required will refer material to appropriate authorities. Do not submit content that is unlawful for you to possess or share.
10. Intellectual property
The GhostTrace name, logo, site content, report formats, and platform are the property of GhostTrace LLC or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the portal and your deliverables for lawful internal purposes. You retain ownership of materials you submit and grant us a limited license to process them solely to provide the services. Feedback you send us may be used without obligation.
11. Confidentiality
We treat engagements as confidential and will not disclose your identity or engagement details except: to our processors as described in the Privacy Policy; where required by law, subpoena, or court order (we will notify you where legally permitted); to protect the safety of any person; or with your consent.
12. Third-party services
Payments run on Stripe; authentication on Google Firebase; email on Resend. Meeting links (e.g., Google Meet, Discord) are operated by their providers. Your use of third-party services is governed by their terms, and we are not responsible for their acts or omissions.
13. Disclaimers
THE SERVICES AND ALL DELIVERABLES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR AVAILABLE AT ANY PARTICULAR TIME, OR THAT FINDINGS WILL ACHIEVE ANY PARTICULAR RESULT, IDENTIFICATION, RECOVERY, OR OUTCOME. WE EXPRESSLY DISCLAIM ANY PROMISE OR GUARANTEE OF RESULTS; YOU ARE PAYING FOR DILIGENT, LAWFUL RESEARCH EFFORT AND PROFESSIONAL METHODOLOGY, NOT FOR A GUARANTEED ANSWER.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) GHOSTTRACE'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF USD $100 OR THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; AND (b) WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, OR DECISIONS YOU OR THIRD PARTIES MAKE BASED ON OUR FINDINGS. Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the fullest extent permitted.
15. Indemnification
You will defend, indemnify, and hold harmless GhostTrace LLC, its members, staff, and contractors from claims, damages, and reasonable attorneys' fees arising out of your misuse of the services, your violation of these Terms, or your violation of any law or third-party right — except to the extent caused by our own willful misconduct.
16. Suspension & termination
You may close your account at any time from the portal or by emailing support. We may suspend or terminate access immediately for violations of Section 6, non-payment, legal requirement, or risk to other users, and otherwise with reasonable notice. Upon termination, your license to the portal ends; Sections 8, 10, 11, 13–15, and 17 survive.
17. Governing law & disputes
These Terms are governed by the laws of the State of Georgia and applicable federal law of the United States, excluding conflict-of-law rules. Before filing any claim, you agree to contact support@ghosttrace.net and attempt good-faith resolution for 30 days. Unresolved disputes shall be brought exclusively in the state or federal courts located in the State of Georgia, and each party consents to the personal jurisdiction and venue of those courts. EACH PARTY WAIVES TRIAL BY JURY TO THE EXTENT PERMITTED BY LAW.
18. General
Force majeure: neither party is liable for delays caused by events beyond reasonable control. Severability: if any provision is unenforceable, the remainder stands. No waiver: failure to enforce a provision is not a waiver. Assignment: you may not assign these Terms without our consent; we may assign to a successor. Entire agreement: these Terms plus the Privacy and Cookie Policies are the entire agreement. Changes: we may update these Terms; material changes will be posted with a new date and, for material adverse changes, notified to registered users in advance.
19. Scope of services
GhostTrace LLC provides cybersecurity consulting, security awareness training, digital safety reviews, entity and domain due-diligence research, exposure monitoring, and documentation support. GhostTrace is not a private detective agency and does not offer private detective or private investigation services. We do not locate persons, identify anonymous parties, conduct surveillance, verify individuals on behalf of third parties, or perform background checks. Requests of that nature are declined and, where appropriate, referred to a licensed agency.
20. Prohibited uses (FCRA)
GhostTrace is not a consumer reporting agency as defined by the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.), and nothing we produce is a consumer report. Our materials may not be used, in whole or in part, to establish eligibility for employment, hiring, promotion, retention, or contractor engagement; tenant screening or housing; credit or insurance underwriting; or any other purpose governed by the FCRA. Clients agree to these restrictions as a condition of engagement.
21. Permissible purpose
Services may not be used for surveillance, stalking, harassment, intimidation, or to compile information about another person. We do not accept engagements whose subject is a natural person, including any current or former romantic partner, spouse, or party to a family or domestic dispute, or any person under 18. We may decline or terminate any engagement at our discretion.
